Accounts created and sessions booked for yourselves or on behalf of others or by a parent/guardian if the participant is under 18 years of age agree to the terms and rules set out below.

In exchange for participation either in-person or online in the activity of spectating, participating, and playing in programs and events organized by Glitch E-Sports and Gadgetverse Ltd, operating as Glitch E-Sports in the E-Sports Lounge located at 9 Paris Street, Exeter, EX1 2JB, United Kingdom, and/or use of the property, facilities, and services of Glitch E-Sports in the E-Sports Lounge, I, [First][Last], agree for myself and (if applicable) for the members of my family, to the following:

AGREEMENT TO FOLLOW DIRECTIONS. I agree to observe and obey all posted rules and warnings, and further agree to follow any oral instructions or directions given by Glitch E-Sports, operating as Gadgetverse Ltd, or the employees, representatives, or agents of Glitch E-Sports.

ASSUMPTION OF THE RISKS AND RELEASE. I acknowledge that there are inherent risks associated with the above-described activity, and I assume full responsibility for personal injury to myself and (if applicable) my family members. I release and discharge Glitch E-Sports and Gadgetverse Ltd from any liability for injury, loss, or damage arising out of our use of or presence upon the facilities of Glitch E-Sports in the E-Sports Lounge, whether caused by our fault, Glitch E-Sports, Gadgetverse Ltd, or other third parties.

INDEMNIFICATION. I agree to indemnify and defend Glitch E-Sports and Gadgetverse Ltd against all claims, damages, judgments, costs, or expenses, including attorney fees, which may arise from our use of or presence upon the facilities of Glitch E-Sports in the E-Sports Lounge.

FEES. I agree to pay for all damages to the facilities of Glitch E-Sports in the E-Sports Lounge caused by any negligent, reckless, or willful actions by me or my family.

APPLICABLE LAW. Any legal claim arising from participation in the above activities shall be resolved under UK law.

NO DURESS. I acknowledge that I am under no pressure or duress to sign this Agreement and have had a reasonable opportunity to review it. Glitch E-Sports and Gadgetverse Ltd have offered to refund any fees if I choose not to sign this Agreement.

ARM'S LENGTH AGREEMENT. This Agreement is the product of an arm's length negotiation between the Parties. Any ambiguity in its interpretation shall not favor one party over the other.

ENFORCEABILITY. The invalidity or unenforceability of any provision of this Agreement shall not affect the validity or enforceability of any other provision.

DISPUTE RESOLUTION. Disputes shall be resolved through friendly negotiation or, if necessary, mediation and arbitration.

AGE REQUIREMENT. By signing up or booking sessions, I acknowledge and agree that I am bound by the terms outlined in this Agreement and any associated waivers.

PRIVACY POLICY. I solemnly affirm that Glitch E-Sports and Gadgetverse Ltd hold customer confidentiality in the highest regard. As such, we pledge that any personal information provided to us will be treated with the utmost respect for privacy and confidentiality. Glitch E-Sports and Gadgetverse Ltd commit to not share, sell, or distribute customer information outside of our companies or subsidiaries. We understand the importance of safeguarding your data and assure you that it will be used solely for the purposes of providing you with the best possible experience at Glitch E-Sports in the E-Sports Lounge. Your trust is invaluable to us, and we are dedicated to upholding the highest standards of integrity and discretion in all our dealings.

MEDIA CONSENT: I hereby grant Glitch E-Sports and Gadgetverse Ltd the absolute right and permission to use photographic portraits, pictures, digital images, or videotapes of myself or any individual on whose behalf I am signing, for any lawful purpose, including but not limited to promotional content for Glitch E-Sports or Gadgetverse Ltd, or their partners. This consent extends to the use of such media in any Glitch E-Sports or Gadgetverse Ltd or partner publication, on Glitch E-Sports or Gadgetverse Ltd websites, or in any other promotional materials, without payment or any other consideration. Additionally, I waive any right that I may have to inspect and/or approve the finished product or the copy that may be used in connection therewith, wherein my or the individual's likeness appears, or the use to which it may be applied. I release, discharge, and agree to indemnify and hold harmless Glitch E-Sports and Gadgetverse Ltd from all claims, demands, and causes of action that I or the individual on whose behalf I am signing have or may have by reason of this authorization or use of the photographic portraits, pictures, digital images, or videotapes, including any liability by virtue of any blurring, distortion, alteration, optical illusion, or use in composite form, whether intentional or otherwise, that may occur or be produced in the taking of said images or videotapes, or in processing tending towards the completion of the finished product, including publication on the internet, in brochures, or any other advertisements or promotional materials.

 

COVID-19 Assumption of Risk, Release, and Indemnification: I acknowledge the risks of COVID-19 exposure and agree to indemnify Gadgetverse for any related claims.
